1. Acceptance of these terms
By accessing or using FlashCutMaker, you confirm that you have read, understood, and agree to be bound by these Terms. If you use the service on behalf of an organization, you represent that you have authority to bind that organization. If you are under 13 (or under 16 in the EEA/UK), do not use FlashCutMaker.
2. The service
FlashCutMaker is a browser-based editor for creating text and image animation videos. The core editor runs in your browser; we provide supporting APIs for image search and an image proxy. Features may change without notice as we improve or replace them.
3. Your account
- Some features (e.g., image search, video generation) require sign-in.
- Authentication is handled by Google via Firebase. Keep your Google account secure.
- You are responsible for all activity that happens under your account.
- You may stop using FlashCutMaker at any time. You can request account deletion at support@flashcutmaker.com.
4. Acceptable use
You agree not to use FlashCutMaker to:
- Violate any law or third-party right;
- Search for, generate, or distribute content that is illegal, infringing, defamatory, hateful, harassing, sexually exploitative of minors, or that promotes violence;
- Attempt to bypass authentication, rate limits, the image proxy’s URL filters, or any other security control;
- Use automated tools to scrape, mass-download, or otherwise abuse the search and proxy endpoints;
- Reverse-engineer or interfere with the service in a way that could damage it or other users;
- Misrepresent your identity or impersonate others.
We may suspend or terminate access for any violation, at our reasonable discretion.
5. Images & user content
5.1 Your content stays yours
You retain all rights to the text, fonts, colors, animation settings, and other inputs you provide. We do not claim ownership of your creative inputs or rendered videos.
5.2 You are responsible for image use
FlashCutMaker can fetch images from third-party sources:
- Unsplash images are licensed under the Unsplash License, which permits broad use but does not grant rights to people, logos, or brands depicted in the photos. Required attribution, where applicable, must be provided by you.
- Brave Search returns general web images. These are not licensed to you. You are responsible for clearing rights or relying on fair use / fair dealing before using a web image in a video you publish.
FlashCutMaker is a tool; it does not certify the licensing status of any image and does not grant you rights to third-party content. You are solely responsible for how you use rendered videos.
5.3 No hosting
We do not host your videos. Rendering happens in your browser; the file you download lives on your device unless you upload it elsewhere.
6. Intellectual property
FlashCutMaker, its name, logo, code, and overall design are owned by us and protected by intellectual property laws. These Terms do not transfer any of our IP rights to you, except for a limited, revocable, non- exclusive license to use the service for its intended purpose. Open-source components, where present, remain governed by their own licenses.
7. Third-party services
FlashCutMaker integrates third-party services described in our Privacy Policy (Firebase Authentication, Vercel, Vercel Analytics, Unsplash, Brave Search, Buy Me a Coffee, Google Fonts). Your use of those services is also subject to their own terms. We are not responsible for their content, availability, or practices.
8. Donations (Buy Me a Coffee)
Donations through Buy Me a Coffee are entirely optional. Donations are non-refundable except where required by law and do not grant you any additional rights, features, or warranties. Buy Me a Coffee handles payment processing under its own terms.
9. Availability & changes
We provide FlashCutMaker on an “as is” and “as available” basis. We may change, suspend, or discontinue any part of the service at any time, including features, APIs, supported file formats, and integrations. We will try to give reasonable notice of significant changes when feasible.
10. Disclaimers
To the maximum extent permitted by law, FlashCutMaker is provided without warranties of any kind, express or implied. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. We make no warranty about the licensing status, accuracy, or fitness of third-party images or content surfaced through the editor.
11. Limitation of liability
To the maximum extent permitted by law, in no event will FlashCutMaker, its operators, or its contributors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from or related to your use of the service. Our total aggregate liability for any claim arising out of or relating to the service is limited to the greater of (a) the amount you actually paid us in the 12 months before the claim arose, or (b) USD $20.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
12. Indemnity
You agree to defend, indemnify, and hold harmless FlashCutMaker and its operators from any claim, demand, or expense (including reasonable attorneys’ fees) arising out of (a) your use of the service, (b) your violation of these Terms, or (c) your violation of any third-party right, including any intellectual property right, related to images or other content you use through the service.
13. Termination
You may stop using FlashCutMaker at any time. We may suspend or terminate your access if we reasonably believe you have violated these Terms or if we discontinue the service. Sections that by their nature should survive (e.g., IP, disclaimers, liability, indemnity, governing law) will survive termination.
14. Governing law
These Terms are governed by the laws of your country of residence to the extent required by applicable consumer-protection law, and otherwise by the laws applicable to the operator of FlashCutMaker, without regard to conflict-of-laws principles. Disputes will be brought in the courts of competent jurisdiction in the operator’s location, except where mandatory law gives you the right to sue in your home jurisdiction.
15. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, surface a notice in-app. Your continued use of FlashCutMaker after changes take effect means you accept the updated Terms.
